Kimberly Offenbacher is in her 18th year of practice as a civil litigator. She received her Juris
Doctor degree from Loyola Law School in 1993 and a Bachelor of Arts degree, cum laude, from
University of California, Santa Cruz (sociology major, environmental studies minor).
Ms. Offenbacher began her legal career with a judicial clerkship for Justice Earl Johnson,
California Court of Appeal, Second Appellate District, Division 7. Although she continues to
enjoy appellate practice, her career is primarily concentrated on civil litigation, both trials and
binding arbitration, with a focus on business litigation, employment law, real property law,
professional negligence and personal injury matters for both plaintiffs and defendants.
RECENT ACCOMPLISHMENTS
In 2011, Ms. Offenbacher successfully opposed a motion for class certification premised on claims of false advertising and unfair competition in the marketing of a Southern California business, which denial facilitated a favorable settlement for the firm’s client.
In 2010, following 5 days of binding arbitration, Ms. Offenbacher obtained an interim defense
award in favor of her client on a cross-complaint for fraud, breach of fiduciary duty and breach of
personal guaranty relative to an exclusive sales representative agreement, potentially valued by the Cross-Complaint at approximately $1.3 million.
Also in 2010, following a 2 day bench trial, Ms. Offenbacher obtained a quiet title judgment in favor of the mortgage holder as against a claim of fraudulent transfer raised by a former owner. That same year, by summary judgment, Ms. Offenbacher obtained judgment in favor of a mortgage holder (on a lien in excess of $2 million) against a quiet title claim brought by a faction of the borrowing church.
Ms. Offenbacher, as co-trial counsel, successfully obtained a fraud judgment in favor of the plaintiffs in excess of $425,000, including punitive damages, in an action establishing that defendants had fraudulently induced plaintiffs to purchase a pharmacy by artificially inflating the value of the pharmacy by engaging in systematic Medicare fraud. The judgment was affirmed on appeal in 2008.
